Mr. Pelton’s practice focuses on the representation of employees in claims for violation of the Fair Labor Standards Act (“FLSA”) and state-law wage and hour laws, as well as sexual harassment, discrimination and class action employment and consumer claims. Mr. Pelton has represented numerous employees in FLSA claims against some of the largest companies in the world. Mr. Pelton carefully reviews all overtime claims and vigorously pursues meritorious claims against employers of all sizes, seeking to recover back wages, liquidated damages, costs and attorneys’ fees.

Mr. Pelton is admitted to the New York and California bars and to the United States District Courts for the Southern and Eastern Districts of New York. Biography:

Prior to founding Pelton & Associates, PC, Mr. Pelton was a founding partner of Pelton Serpe LLP, an employment and consumer rights law firm. Mr. Pelton previously worked as an associate in the New York office of Lewis Brisbois Bisgaard & Smith LLP, one of the nations 100 largest law firms. Mr. Pelton’s practice focused on directors and officers’ liability claims arising out of corporate transactions and allegations of securities fraud while also defending employers in FLSA overtime claims. Mr Pelton also defended professional liability, employment and negligence claims while providing coverage and litigation advice for stock option backdating, late trading and market timing, and major securities litigation. More recently, Mr. Pelton has served as co-lead or lead counsel on numerous class and collective employment actions and he has recovered millions of dollars on behalf of his clients.
